UNESCO Chair on CHL and China Cultural Relics Newspaper Press held public training courses on “Cultural Heritage Law and Policy”

In order to promote cultural heritage law and policy to cultural heritage practitioners and the public, the UNESCO Chair on CHL, in cooperation with China Cultural Relics Newspaper Press, held the public training courses on “Cultural Heritage Law and Policy” from November 16 to 18, 2021. The course invited six renowned experts in the field of cultural heritage law, Professor Guo Yujun, Professor Tian Yan, Professor Wei Xiaoyang, Associate Professor Li Xirui, Dr. Hu Shanchen(the member of the Chair) and Professor Wang Yunxia (the Chair holder), to bring six exciting lectures to cultural heritage practitioners and enthusiasts online.

On the morning of November 16, Professor Guo Yujun from Wuhan University School of Law gave a presentation titled "Legal Issues in Art Transactions". Prof. Guo gave a detailed analysis of the global overview of art transactions, the legal risks of art transactions and their prevention, and the legal issues related to NFT artworks. She introduced the ownership risks, infringement risks, money laundering and terrorism financing risks and ways to prevent them in art transactions, and explained the legal issues involved in NFT artworks.

In the afternoon of November 16, Professor Wei Xiaoyang from the School of Cultural Industry Management of Communication University of China gave a lecture entitled "Legal Issues Related to Cultural Industry in the Protection and Utilization of Cultural Heritage". Based on the background of cultural industry development, Prof. Wei taught the issues of cultural heritage protection and utilization and public law, intangible cultural heritage preservation and copyright law, intangible cultural heritage and civil law, digital cultural heritage protection and copyright law, and sorted out the relevant legal provisions and classic cases.

In the morning of November 17, Professor Tian Yan from the Law School of Minzu University of China gave a presentation entitled "Legal Protection of Intangible Cultural Heritage". Prof. Tian introduced the concept of intangible cultural heritage, the theoretical basis and working principles of intangible heritage protection, the requirements of investigation and recording, the process of declaration and evaluation of representative projects, the identification, evaluation and withdrawal mechanism of representative inheritors, the system of protection units, the classification and protection of intangible heritage, the rational use of intangible heritage, and the protection of intellectual property rights. She illustrated and explained with the practice of protection and utilization of intangible cultural heritage in different places.

In the afternoon of November 17, Associate Professor Li Xirui of North China Electric Power University gave a presentation titled "Copyright Issues in Cultural and Creative Product Development of Cultural Heritage Institutions". She introduced the issues of copyright legality, copyright ownership, and reasonable use in the development and utilization of cultural and creative products. She explained the legal regulations applicable to different types of copyrighted cultural resources and put forward the idea of improving China's copyright legal system.

On the morning of November 18, Dr. Hu Shanchen from the School of Law of Minzu University of China gave a lecture entitled "The Impact of the World Heritage System on the Rule of Law of Cultural Heritage in China". Dr. Hu explained four issues: the emergence and purpose of the World Heritage Convention, the development of the World Heritage system and the responsibilities of States Parties, the response and development of China's World Heritage law, and suggestions for improving China's World Heritage law. She organically combined domestic and international systems and practices, and put forward the basic ideas of China's World Heritage law construction.

In the afternoon of November 18, Prof. Wang Yunxia from the Law School of Renmin University of China gave a lecture entitled "Balancing Public and Private Interests in the Protection and Utilization of Cultural Heritage". Taking the case of unauthorized demolition of cultural relics by villagers in Zhiyan Village, Lanxi, Zhejiang Province as an introduction, Prof. Wang introduced the definition and types of cultural heritage, and explained why cultural heritage protection involves public interests, the entanglement of interests involved in cultural heritage protection, and the ways to balance public and private interests through legal means. She pointed out that the balance of public and private interests in cultural heritage protection should be promoted by improving laws and regulations and promoting public participation.

The lectures of this training course focused on the basic, cutting-edge and practical issues in the field of cultural heritage law. The lectures were theoretical and practical, and combined domestic issues and international perspectives, which were highly evaluated by the participants. After the lectures, the participants actively asked questions and interacted with the lecturers, which enhanced the communication between experts and scholars and cultural heritage practitioners. The link to the live broadcast of the course received nearly 20,000 hits and had a wide impact on the cultural heritage industry. In the future, the UNESCO Chair on CHL will further cooperate with China Cultural Relics Newspaper Press to promote more public courses.
